Terms of Service: Australia Addendum

This Australia Addendum (“Addendum”) supplements, and forms part of, the RealmForge Terms of Service (the “Terms”). It applies only to users located in Australia. See also the Privacy Policy Australia Addendum. Where this Addendum conflicts with the Terms, this Addendum prevails for users located in Australia. Capitalized terms used in this Addendum have the meanings given in the Terms unless otherwise defined here.

1. Application

This Addendum applies to users who are residents of Australia and who access or use the Services from within Australia. If your app store account is registered in Australia, the App records Australia as your country of residence. You must not misrepresent your country of residence. Contact us at info@realmforgeapp.com if it needs to be corrected.

2. Eligibility

You must be at least eighteen (18) years of age to use the Services in Australia.

3. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth) (the “ACL”). Nothing in the Terms or this Addendum excludes, restricts, or modifies any guarantee, right, or remedy you have under the ACL or any other law that cannot lawfully be excluded, restricted, or modified. Where the Terms say that a purchase is final or non-refundable, that the Services are provided “as is” or without warranty, or that our liability is limited, those statements apply only to the extent permitted by the ACL. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

Purchases of Forge Sparks are processed by Apple or Google, and refund requests for those purchases may also be made through the app store from which the purchase was made.

4. Essence Loyalty Rewards (Australia)

Essence redemption is not yet available to residents of Australia. You may continue to earn and accumulate Essence while you are a resident of Australia. You may not submit a redemption request, and the App will not offer one to you. Essence you accumulate has no cash value and is not a promise of any future reward. If redemption becomes available in Australia, we will notify you through the Services and update these Terms before it does. Nothing in these Terms promises that redemption will become available in Australia.

5. Weekly Prize Drawing (Australia)

The Weekly Prize Drawing is not available to residents of Australia, and the App will not accept an entry from an account whose country of residence is Australia.

6. No Financial Product or Yield (Australia)

Consistent with Section 6 of the Terms, Essence, Forge Sparks, Artifacts, and all other virtual items are provided solely for entertainment and enjoyment. They are not a financial product, a managed investment scheme, a security, a deposit, or a yield-bearing instrument under Australian law, and they do not represent a promise of income, interest, or any other return.

7. Electronic Messages

Where the Company sends commercial electronic messages, it does so in accordance with the Spam Act 2003 (Cth): only with your consent or where otherwise permitted, identifying the Company as the sender, and with a functional way to unsubscribe.

8. Dispute Resolution and Governing Law (Australia)

Section 23 (Dispute Resolution and Arbitration) and Section 24 (Governing Law) of the Terms do not apply to residents of Australia. Instead:

(a) Informal resolution. Before starting a proceeding, please contact us at info@realmforgeapp.com with a written description of your claim so that we can try to resolve it with you in good faith. This does not limit any time period or right you have under applicable law.

(b) No arbitration and no class action waiver. You are not required to arbitrate any dispute with us, and nothing in the Terms waives your right to bring or participate in a representative proceeding where Australian law permits it.

(c) Governing law. These Terms and this Addendum are governed by the laws of the Australian state or territory in which you reside and the laws of the Commonwealth of Australia applicable in it.

(d) Courts and tribunals. You may bring a claim in the courts or tribunals of your state or territory of residence, including a small claims court or consumer tribunal where your claim qualifies. You may also contact your state or territory consumer protection agency or the Australian Competition and Consumer Commission.
