Privacy Policy: Canada Addendum

This Canada Addendum (“Addendum”) supplements, and forms part of, the RealmForge Privacy Policy (the “Policy”). It applies only to users located in Canada, including the Province of Quebec, and in particular to personal information subject to the Personal Information Protection and Electronic Documents Act (“PIPEDA”). Where this Addendum conflicts with the Policy, this Addendum prevails for users located in Canada. Capitalized terms have the meanings given in the Policy unless otherwise defined here.

1. Scope and Application

This Addendum applies to the collection, use, and disclosure of personal information about users who are residents of Canada, including the Province of Quebec, in the course of commercial activity. The Services are currently offered to residents of all Canadian provinces and territories, including Quebec. The provisions of this Addendum that refer to the Quebec Act respecting the protection of personal information in the private sector (“Quebec Law 25”) apply to users located in Quebec. Where the Personal Information Protection Act of Alberta or the Personal Information Protection Act of British Columbia applies to personal information we collect, the corresponding provisions of that law also apply.

2. Consent

We collect, use, and disclose personal information with your knowledge and consent, except where collection, use, or disclosure without consent is permitted or required by law. Consent may be express or implied depending on the sensitivity of the information and your reasonable expectations. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Where we rely on consent for personalized advertising or for sharing with integrated partners such as survey, offerwall, travel, or shopping providers, that consent is express and may be revoked through your device permissions or in-app settings.

For users located in Quebec, consent must be clear, free, informed, and given for specific purposes, and it must be requested for each purpose in clear and simple language. Sensitive information is collected only with manifest, express consent.

3. Collection, Use, and Disclosure

The types of information we collect, the purposes for which we use them, and the categories of recipients are described in the Policy. We limit collection to information that is necessary for those identified purposes. The offerwall, survey, and third-party offer features involve Offer Partners who may collect or receive information from you; those Offer Partners are responsible for their own privacy practices, which are governed by their respective privacy policies.

If your app store account is registered in Canada, we also collect the province or territory of residence you declare in the App. We use it only to apply the rules that depend on where you live, such as the skill-testing question required of Canadian prize winners and the rules relating to Essence redemption.

4. Privacy Officer and Individual Requests

You may request access to your personal information, request correction of inaccurate information, or ask questions about our privacy practices by contacting our Privacy Officer at info@realmforgeapp.com. We respond to access and correction requests within the time periods required by applicable law, and we may require you to verify your identity before responding.

If you are not satisfied with our response, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada or, where it applies, with the Information and Privacy Commissioner of Alberta or of British Columbia. If you are located in Quebec, you may also file a complaint with the Commission d’accès à l’information du Québec.

For users located in Quebec, the person in charge of the protection of personal information can be reached at info@realmforgeapp.com. You have the right to access and correct your personal information, the right to withdraw consent, and the right to request the cessation of dissemination of your personal information or the de-indexation of certain information where permitted by law.

5. Security and Breach Notification

We maintain safeguards appropriate to the sensitivity of the information we hold, as described in the Policy. If we experience a breach of security safeguards involving personal information and the breach creates a real risk of significant harm to you, we will report the breach to the applicable privacy commissioner and notify you in accordance with applicable law. We keep a record of every breach of security safeguards involving personal information, whether or not it is reportable, for at least twenty-four (24) months after we determine that the breach occurred.

For users located in Quebec, we will also report to the Commission d’accès à l’information any confidentiality incident that presents a risk of serious injury, and we will keep a register of confidentiality incidents in accordance with Quebec Law 25. Where a project involving the acquisition or use of personal information creates privacy risks, we will conduct a privacy impact assessment as required by law.

6. Cross-Border Transfers

Personal information may be stored or processed in the United States or other jurisdictions, and may be accessible to courts, law enforcement, and national security authorities in those jurisdictions under their laws. Where personal information is transferred or processed outside Canada, we take reasonable contractual and other measures to protect it in accordance with this Addendum.

Our service providers that collect, store, or process personal information outside Canada do so in the United States (including our hosting and database providers) and in Germany (our Offer Partner, ayeT-Studios GmbH, for the offerwall and survey wall). You may ask questions about the collection, use, disclosure, or storage of personal information by our service providers outside Canada by contacting our Privacy Officer at info@realmforgeapp.com.

For users located in Quebec, before communicating personal information outside Quebec we will conduct a privacy impact assessment where required and will take measures to ensure the information receives protection equivalent to Quebec’s safeguards.

7. Automated Decision-Making

The Services may use automated processes for fraud prevention and for determining reward eligibility. Where an automated decision produces legal effects concerning you or significantly affects you, you may request to have the decision reconsidered by a person by contacting info@realmforgeapp.com.

8. Retention and Deletion

We retain personal information only as long as necessary for the purposes described in the Policy and as required by law. You may request deletion of your account as described in the Policy. Where we retain a cryptographic fingerprint of an email address after account deletion for fraud prevention, that retention is limited to the purpose described in the Policy.

9. Language

A French version of this Addendum and of all documents relating to it has been made available to you before you accepted them, in accordance with the Charter of the French Language (Quebec). Having had access to that French version, the parties have expressly requested that this Addendum and all documents relating to it be drawn up in English. Une version française de la présente Annexe et de tous les documents qui s’y rattachent a été mise à votre disposition avant que vous ne les acceptiez, conformément à la Charte de la langue française (Québec). Après avoir eu accès à cette version française, les parties ont expressément exigé que la présente Annexe ainsi que tous les documents qui s’y rattachent soient rédigés en anglais.
