Terms of Service: Canada Addendum

This Canada Addendum (“Addendum”) supplements, and forms part of, the RealmForge Terms of Service (the “Terms”). It applies only to users located in Canada, including the Province of Quebec. See also the Privacy Policy Canada Addendum and the Official Rules Canada Addendum. Where this Addendum conflicts with the Terms, this Addendum prevails for users located in Canada. Capitalized terms used in this Addendum have the meanings given in the Terms unless otherwise defined here.
1. Application
This Addendum applies to users who are residents of Canada, including the Province of Quebec, and who access or use the Services from within Canada. The Services are currently offered to residents of all Canadian provinces and territories, including Quebec. The Services remain governed by the Terms for all other users.
2. Eligibility
In addition to the eligibility requirements in the Terms, you must be at least the age of majority in your province or territory of residence in Canada. The age of majority is eighteen (18) in Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, and Saskatchewan, and nineteen (19) in British Columbia, New Brunswick, Newfoundland and Labrador, the Northwest Territories, Nova Scotia, Nunavut, and the Yukon.
If your app store account is registered in Canada, the App will ask you to declare your province or territory of residence. You must answer accurately. Your declaration is recorded once and cannot be changed in the App; contact us at info@realmforgeapp.com if it needs to be corrected. Declaring a false residence is a violation of these Terms, and we may suspend or terminate an account, and withhold or reverse any prize or benefit, where a declaration is found to be false.
3. Canadian Consumer Protection
Nothing in the Terms or this Addendum excludes, restricts, or modifies any right or remedy you have under the consumer protection legislation of your province or territory of residence, or under the federal Competition Act, to the extent those rights cannot lawfully be excluded, restricted, or modified by contract. In particular, the “final and non-refundable” language in Section 10 of the Terms applies only to the extent permitted by applicable consumer protection law, and does not restrict any statutory refund, cancellation, or chargeback right you may have.
4. No Securities or Yield (Canada)
Consistent with Section 6 of the Terms, Essence, Forge Sparks, Artifacts, and all other virtual items are provided solely for entertainment and enjoyment. They are not, and shall not be construed as, a security under the securities legislation of any Canadian province or territory, an investment, a deposit, or a yield-bearing instrument, and they do not represent a promise of income, dividends, interest, or any other return. The purchase of any virtual item is a purchase of a limited license for entertainment purposes only and is not the purchase of an investment contract or a security. No sale of a virtual item is subject to the prospectus or registration requirements of Canadian securities law because no virtual item constitutes a security or an investment contract, and nothing in the Services is offered as an investment.
5. Essence Loyalty Rewards (Canada)
Essence redemption is not currently available to residents of Canada, as stated in Section 8 of the Terms. You may continue to earn and accumulate Essence while you are a resident of Canada. You may not submit a redemption request, and the App will not offer one to you. Essence you accumulate has no cash value and is not a promise of any future reward. If redemption becomes available in Canada, we will notify you through the Services and update these Terms before it does.
6. Anti-Spam and Communications
The Company complies with Canada’s Anti-Spam Legislation (“CASL”). Where the Company sends commercial electronic messages, it does so only with your consent as required by CASL, or where otherwise permitted by applicable law, and each such message identifies the sender and provides an unsubscribe mechanism. The offerwall, survey, and third-party offer features may involve communications from Offer Partners; those communications are governed by the Offer Partner’s own terms and privacy practices.
7. Dispute Resolution and Governing Law (Canada)
Section 23 (Dispute Resolution and Arbitration) and Section 24 (Governing Law) of the Terms do not apply to residents of Canada. Instead:
(a) Informal resolution. Before starting a court proceeding, please contact us at info@realmforgeapp.com with a written description of your claim so that we can try to resolve it with you in good faith. This does not limit any time period or right you have under applicable law.
(b) No arbitration and no class action waiver. You are not required to arbitrate any dispute with us, and nothing in the Terms waives your right to bring or participate in a class proceeding where applicable law permits it.
(c) Governing law. These Terms and this Addendum are governed by the laws of your province or territory of residence and the federal laws of Canada applicable in it.
(d) Courts. You may bring a claim in the courts of your province or territory of residence, including a small claims court where your claim qualifies.
8. Language
A French version of this Addendum and of all documents relating to it has been made available to you before you accepted them, in accordance with the Charter of the French Language (Quebec). Having had access to that French version, the parties have expressly requested that this Addendum and all documents relating to it be drawn up in English. Une version française de la présente Annexe et de tous les documents qui s’y rattachent a été mise à votre disposition avant que vous ne les acceptiez, conformément à la Charte de la langue française (Québec). Après avoir eu accès à cette version française, les parties ont expressément exigé que la présente Annexe ainsi que tous les documents qui s’y rattachent soient rédigés en anglais.
